These Terms and Conditions apply to all photography services provided by Tiny Treehouse Studio (“we”, “us”, “our”) at childcare centres and similar locations across New South Wales, Australia. By booking our services or purchasing our products, you (“you”, “your”, “the client”) agree to be bound by these Terms and Conditions.

1. Booking and Consent

  • All photography sessions photo dates/days must be booked through the childcare centre or directly with a parent/guardian.
  • Parents or legal guardians must register online via our website, giving us consent to photograph your child.
  • For those without internet access, a signed consent form from a parent or legal guardian is required.
  • Photographs will not be taken without registration or consent.
  • We reserve the right to refuse or cancel sessions if consent is not properly obtained.

2. Photography Session

  • Sessions will be conducted on agreed dates and times at the childcare centre.
  • We aim to capture high-quality images, but expressions/poses cannot be guaranteed.
  • Centre staff may assist for safety and comfort of the children.
  • We provide one photographer and one assistant during sessions.

3. Ordering and Payment

  • Orders may be placed online by parents/guardians.
  • Offline paper forms are available for those without internet.
  • Full payment is required unless otherwise agreed in writing.
  • 10 business days are provided to place orders. Late orders may incur a $15 fee.
  • Prices include GST and are in AUD.

4. Delivery

  • Print packages are delivered in bulk to the centre.
  • Printed orders are delivered within 15 business days after the last photography day.
  • Delivery delays may occur due to external reasons.

5. Refunds and Replacements

  • Refunds/replacements apply for faulty goods under the Australian Consumer Law.
  • No refunds for change of mind, expression/pose preferences, or external delays.
  • Report issues within 14 days of receiving the order.

6. Use of Images

  • Images are used for ordering only, not for marketing without consent.
  • Images remain copyrighted to Tiny Treehouse Studio.
  • Purchase of digital images grants a personal-use only license.
  • No editing of digital images is allowed by the customer.

7. Limitation of Liability

  • We are not liable for any loss, damage, or expense arising from:
    • Illness, accidents, or emergencies
    • Acts or omissions by the childcare centre
    • Technical issues outside our control

8. Privacy

We are committed to protecting your personal information in accordance with the Privacy Act 1988 (Cth). Please refer to our Privacy Policy for full details.

9. Changes to Terms

We may update these Terms and Conditions as needed. Latest version is available on our website or on request.

10. Governing Law

These Terms are governed by NSW and Commonwealth law. Disputes will be handled under Australian Consumer Law and NSW regulations.
